1. Acceptance of Terms
By accessing or using the Bricks & Numbers platform (the "Platform"), operated by Bricks & Numbers Pty Ltd ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform.
2. Description of Service
The Platform provides AI-powered development feasibility analysis, including zoning intelligence, financial modelling, legal risk assessment, and compliance checking for residential development sites in New South Wales, Australia. The Platform is intended as a decision-support tool and does not constitute professional advice.
3. Account Registration
To use certain features of the Platform, you must create an account. You agree to: provide accurate and complete information during registration; maintain the security of your account credentials; notify us immediately of any unauthorised use of your account; and accept responsibility for all activities that occur under your account.
4. Subscriptions & Payments
Access to the Platform may require a paid subscription. By subscribing, you agree to pay all applicable fees as described at the time of purchase. Subscriptions renew automatically unless cancelled before the renewal date. We reserve the right to modify pricing with reasonable notice. Refunds are handled in accordance with Australian Consumer Law.
5. Acceptable Use
You agree not to: use the Platform for any unlawful purpose; attempt to gain unauthorised access to the Platform or its systems; reproduce, distribute, or resell any content or data from the Platform without our written consent; use automated tools to scrape, harvest, or extract data from the Platform; or interfere with or disrupt the Platform's operation or servers.
6. Intellectual Property
All content, software, algorithms, designs, and data on the Platform are owned by or licensed to Bricks & Numbers Pty Ltd and are protected by Australian and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Platform for its intended purpose. Feasibility reports generated by the Platform may be used for your own business purposes but may not be resold or redistributed commercially.
7. Data Accuracy & Limitations
While we strive to provide accurate and up-to-date information, the Platform relies on publicly available planning data, market information, and financial modelling assumptions. We do not guarantee the accuracy, completeness, or currency of any information provided. All outputs are indicative and should be verified independently before making investment or development decisions.
8. Limitation of Liability
To the maximum extent permitted by law, Bricks & Numbers Pty Ltd, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to: loss of profits, revenue, or business opportunities; decisions made based on Platform outputs; or inaccuracies in planning data or financial projections. Nothing in these Terms excludes or limits any rights you may have under the Australian Consumer Law that cannot be excluded or limited.
9. Indemnification
You agree to indemnify and hold harmless Bricks & Numbers Pty Ltd from any claims, damages, or expenses arising from your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.
10. Termination
We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Any provisions that by their nature should survive termination shall remain in effect.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
